Pathway to Aus Key Responsibilities: Oversee Contracts for Educational Providers: Draft, review, and manage agreements with universities and private educational providers to ensure compliance with Australia’s regulatory framework for education services, including the Education Services for Overseas Students (ESOS) Act 2000 and the National Code of Practice for Providers of Education and Training to Overseas Students 2018 . Assist with Migration-Related Agreements: Collaborate with registered migration agents to draft client agreements under the Australian migration framework, including but not limited to skilled migration and employer-sponsored visa agreements, ensuring compliance with the Migration Act 1958 , Migration Regulations 1994 , and any industry-specific visa agreements such as Labour Agreements including Designated Area Migration Agreements (DAMA), Company Specific Labour agreements and Industry Labour Agreement . Ensure Compliance with Legal and Regulatory Standards: Ensure all contracts, both education and migration-related, adhere to relevant legislation, regulations, and organizational policies. This includes understanding the legal obligations of education providers, as well as those of employers under Australian immigration law. Contract Review and Risk Management: Assess risks related to contracts and agreements, ensuring they comply with relevant legal, financial, and operational standards. This includes reviewing partnership agreements, service contracts, and vendor agreements to ensure alignment with regulatory frameworks. Management of Contractual Amendments and Renewals: Handle amendments and renewals of contracts with a keen focus on regulatory changes in the education and migration sectors, ensuring that all agreements remain compliant with current laws and practices. Support for Complex Agreements: Work closely with legal counsel and stakeholders on complex or high-risk agreements, particularly in the areas of education services and migration-related labour agreements. Aid in the preparation of documentation for lodging Labour Agreements with the Department of Home Affairs, and support industry consultation requirements for these agreements. Qualifications & Experience: Bachelor’s degree in law, Business, or a related field. Minimum 2 years of full-time work experience in contract administration, preferably within the education or migration sectors. Strong understanding of regulatory requirements in the Australian education sector, particularly the ESOS Act and the National Code . Knowledge of Australian immigration laws, including the Migration Act and Migration Regulations , particularly as they relate to migration related agreements. High attention to detail, with excellent organizational and time management skills. Proficiency in Microsoft Office Suite, Google Drive, Salesforce, and contract management systems.
